Roman" LANG=3D"0">As scheduled, the Attorney General on behalf of Governor=20=
Vilsack formally replied a week ago Thursday to a lawsuit filed by the legis=
lature challenging the Governor's use of the item veto of key business clima=
te issues and tax reform from what the legislature believed was policy legis=
lation. The Iowa Constitution only allows the item veto of specific items in=
appropriations bills.In the answer, Vilsack denies usurping his constitutio=
nal authority in item vetoing workers' comp and liability reform measures as=
well as the tax reform, which he claims were all part of legislation with a=
ppropriations impact.The next phase will be to have the case argued in Polk=20=
County District Court. The judge has agreed to a timetable that will put the=
case before the court prior to the end of October. Some Democrat lawmakers=20=
have threatened to intervene in the suit in an attempt to keep business clim=
ate reforms from becoming law if the Iowa Supreme Court ultimately finds Vil=
sack's actions illegal</FONT><FONT COLOR=3D"#000000" style=3D"BACKGROUND-CO=

Myers.The election of Jacoby puts the balance of power in the House at 53 Re=
publicans and 47 Democrats. Democrats picked up a seat earlier this summer w=
