[IASHRM] Wage question regarding Independent Contractors

Hi Katie, 

 

If the person is truly an independent contractor, they are in control of
when they work, and they hand you a bill with their hourly rate periodically
or upon completion of their project.  If this is the case, you are not
required to pay them any amount other than their hourly bill rate. Then, if
the independent contractor has earned more than $600 in the calendar year,
you should provide them with an IRS form 1099 and report their earnings to
the IRS.

We are in the process of hiring an independent contractor and wanted to see
if they are in a position that is classified as "exempt" are we still
required to pay them OT because they are paid an hourly rate?

Does anyone have experience with something like this?
